This website is owned and operated by Pony Ltd., Unit 12a Albion Street, City Business Centre, Lower Road, London SE16 2XB, UK. Your use of this website is subject to the Terms as set out below. By accessing and using this website you agree that you have read, understood and accept these Terms. If you do not read or agree with our Terms, you should not access this website. Our Terms do not affect your statutory rights.

Pony Ltd., Pony Shop and the Things we Sell
Pony Ltd. is a small design and art studio based in London, UK. From time to time we make artworks and items that we then make available for people to purchase from us through the Pony Shop pages on this website. We sell these items in the understanding that you (the purchaser) acknowledge your understanding of what you are buying, what the items are, and the context and subject matter they explore, visually or otherwise. We cannot be held responsible in any way for how you or the recipient or anyone else anywhere, may interpret them, now or any time or place in the future.

We also publish a small range of print works with artists. These are also available to trade enquiries and bulk orders. We do not operate "sale or return" on trade or bulk orders.

We have our own standards of manufacture, craft and production. Each item we make is created to the standards we deem suitable to the context and concept of each individual item. Their quality, material, concept and the content of their subject matter, visual or otherwise, are described and displayed on each item page. Some elements of our items use third party materials or products as part of their constituent parts. We sell our items as “complete works”. Any third party product we have used has been selected for its appropriateness to the manifestation of our items and artworks. We have included any relevant details on each item page as a guide, as you may want to investigate further. We have also included some extra information on materials, expectations, concept and story for each kind of item in their relevant sections in the Pony Shop pages, as well as suggested care and use, if relevant.

We are not a retail store and do not operate as such. We do not operate a 24-hour, 7 days-a-week, 365 days-a-year Pony Shop. We are often away from the studio for periods of time, whether for personal or work reasons. We might be just out walking the dog. Though our website will take orders while we are not in the studio, we can only process them when we are there. If we are not going to be in the studio for longer than one week, we will post this on the Pony Shop page of our website, together with our estimated date of return. We will process orders as and when we can, all within reasonable time periods.

The same goes for any returns, cancellations, refunds or handling any other issues that might arise (as detailed later below in these Terms). We can only process these when we are in the studio. If we are away from the studio for a significant length of time during your ordering period, we will let you know so that we can agree a revised schedule or procedure. Please bear with us and we will aim to resolve as soon as we can. We are only human after all.

Please feel free to contact us about any of our artworks or items before you make an order, just in case you are unclear about anything. We may also have other artworks, such as poster prints or one-offs, that are not shown on the Pony Shop pages of our website, but that may be more what you are looking for. These items may differ in price to any similar displayed on the Pony Shop pages. In any case, our Terms will still apply.

User conduct
In using this website, including all materials available through it, you represent, warrant and agree not to disrupt or interfere with the security of, or otherwise cause harm to, the website, materials, system resources, servers, or networks connected to or accessible through the site or any affiliated or linked websites; not to upload, post or otherwise transmit through the website any viruses or other harmful, disruptive or destructive files; not to provide any false personal information; not to intentionally or unintentionally violate any applicable local, state, national or international law, or any regulations having the force of law; and to indemnify us in respect of any and all claims brought by a third party against us arising out of or in connection with a breach of any of the foregoing.

We use PayPal Standard to process all orders through the Pony Shop on our website. All transactions are carried out through the PayPal site, externally to our website.

Pricing, VAT & Delivery Costs
All the prices in the Pony Shop pages of our website are in British Pounds (Sterling), and include UK VAT (Value Added Tax) at the appropriate rate. Non-EU customers are not charged VAT. During the PayPal checkout process, the price will appear without VAT until the final steps. At this point PayPal determines if you are in or out of the EU, and applies the relevant VAT amount.

We will email you a PDF VAT invoice (paid) as part of your order acceptance and confirmation. We generally process orders on a Thursday, and despatch on a Friday.

Prices include delivery anywhere in the world, but only if the delivery address and contact details you have provided PayPal (and they in turn have provided us) are valid and to which we can easily send our items and artworks. 

Local Duties and Taxes
Please note that prices are not inclusive of any taxes, duties or import fees that may be charged when a package reaches its destination country. Orders shipped outside the EU are done so on a Delivered Duty Unpaid basis. Therefore, you are liable for any import duties and or local taxes that may be incurred. We will include appropriate customs labels on any packages, but we are not responsible for the decisions of local customs officials.

Timings, Despatch and Delivery
Orders are processed differently for each artwork. In general, we process in-stock items on a Thursday and despatch on a Friday. For made-to-order artworks, such as the poster prints, it may take up to two weeks from acceptance of your order before we have the item ready to despatch. If an item is unexpectadely out of stock (such as a silk scarf or t-shirt) we will let you know and suggest alternatives, extended delivery times or cancellation.

For delivery, we use Royal Mail International Standard, or First Class in the UK, as our standard. For more expensive orders we ship tracked and/or signed for.

As you can imagine, depending how far away from us you are, delivery times will vary. By the time we say goodbye to your order at the studio, it should generally take 1-3 working days in the UK, 3-5 working days within the EU, and 5-10 working days outside the EU. The items and artworks are insured in transit until they are delivered. Different times of year, exact locations, opening times, local holidays and seasons also have an inevitable impact on delivery times. We can only work with the systems provided.

All our artworks are packaged suitably for their protection during shipping. We do keep it as simple as possible, with no frills or expensive boxes. We use recyclable materials where possible.

We must receive PayPal notification of payment for the artworks you order before your order can be accepted and processed. PayPal will email you confirmation of payment and that your order details have been sent to us. We will email you (to the email address you have provided PayPal with) once we have in person received your order notification from PayPal. We generally do this on a Thursday. Our email will confirm your order and our acceptance details of it. Our acceptance of your order brings into existence a legally binding contract between us. If there are any issues with your order — such as items unexpectedly out of stock or relating to made-to-order items — we will inform you by email so that we can work out what you want to do (e.g. suggest alternatives, extended delivery times or cancellation).

We reserve the right to refuse service to anyone for any reason at any time.

You may not violate our intellectual property rights in any way, anywhere.
You may not use our items or artworks for any illegal or unauthorized purpose, nor may you, in the use of this website, violate any laws in your jurisdiction (including but not limited to copyright laws).

Contact and Delivery Details
Please make sure you provide PayPal with clear and valid contact and delivery details, including your active, valid email address.

Damaged, Incorrect or Faulty Items 
In the case that items are delivered to you damaged, incorrect or faulty, then please contact us immediately at ponyshop@ponybox.co.uk and we will work out the most appropriate solution with you, as different items and circumstances will require different solutions.

UK Returns
If you are not satisfied with any items purchased, you can return them to us within 14 days for refund or exchange. Please notify us by email immediately, and then return unwanted or incorrect items in perfect, resalable condition, including the original packaging. You are liable for the cost and risk of returning the item(s). We recommend you obtain a Proof of Postage Certificate from the Post Office or courier.

Made-to-order, bespoke or personalised items (such as poster prints) cannot be returned.

International Returns 
We regret that we cannot accept international returns.

EU Cancellations
Under the Distance Selling Regulations, EU customers have 14 days after their order is delivered to cancel their purchase. Order cancellations must be made in writing to ponyshop@ponybox.co.uk
If you cancel your order before it has been despatched (see Global Cancellation Exceptions below) we will refund the total. If you cancel an order that has already been despatched or delivered, you must return the goods, in perfectly resalable condition, within 14 days of informing us of your order cancellation. You are  liable for the cost and risk of returning the order. Once we receive and inspect our items, we will refund the purchaser minus the original order shipping cost (as noted on the order invoice emailed to you) within 14 days. 

Non-EU Cancellations
If you feel you want to cancel, then let us know immediately: ponyshop@ponybox.co.uk
If the order has not yet despatched, then we can cancel and will refund you (see Global Cancellation Exceptions below). If the order has already been despatched, it cannot be cancelled.

Global Cancellation Exceptions
Any bespoke, made-to-order, commissioned or personalised items, once in manufacture cannot be cancelled.

Our poster print artwork editions are made-to-order, hand-signed & dated by the artist, Pony stamped with a seal of authenticity. If you suddenly want to cancel a print order, contact us immediately. If the poster print order has gone to manufacture, the order cannot be cancelled.

We are Reasonable People

Accuracy of Description
We aim to give you accurate descriptions of all our items, in words and pictures. Due to the nature of digital reproduction and screen calibration we cannot guarantee the accuracy of colour depictions of our items on any screen or device you may be looking at. If you have any questions before ordering, just ask.

Security and Privacy
This privacy policy outlines how we deal with any personal data you provide to us while visiting this website. If you are not happy with our privacy policy you should not use this website. By visiting and using this website, you are accepting the terms of this privacy policy.

We respect your privacy. We do not gather data from you on our website. We use PayPal Standard to carry out the full cart and checkout transaction, including the gathering of contact and delivery details. The information we receive from PayPal is the minimum standard required to process your order. We do not hold or store any payment information details, including credit card numbers or bank details. We do not make sales phone calls and will only ever email in relation to an order. We do not pass your telephone number, email address or other details to any other organisations other than to process your order or as required by law. We will send order & despatch confirmation and other relevant emails related only to orders you have placed to the email address provided by you to PayPal. 

Intellectual Property
By using this website you agree that all the information, communications, photography, text, images, graphics, software, trademarks, trade names, logos and other materials and services on this website (the “content”) are protected by copyright, trademark, database rights, sui generis rights and other intellectual property laws under the laws of England, UK and international treatise. All property rights, title and interest in and to the content shall be at all times and for all purposes remain vested in Pony Ltd. and/or its licensors, as the case may be. You agree not to copy, modify, transmit, display, distribute, perform, reproduce, license, publish, create derivative works from, transfer or sell any information contained on or forming part of this website, or otherwise use such content of this website for re-sale, re-distribution or for any other commercial use, without the consent of Pony Ltd. and/or its licensors as the case may be.

Any external links to other websites are clearly identifiable as such, and we are not responsible for the content or the privacy policies of third party websites. Your use of third party websites is subject to the terms and conditions of use contained within each of those websites. Pony Ltd. is not liable or responsible for the accuracy of any information, data, opinions or statements on these websites or the security of any link or communication with those websites.

While we make every reasonable effort to maintain this website in an accurate and up-to-date fashion it may contain some technical or other mistakes, inaccuracies or typographical errors. We cannot be held responsible for any mistakes or omissions on this website. We will always correct anything that comes to our attention.

While we make every reasonable effort to uphold our website, communications and anything else related to the processing of orders, we are at the mercy of technology, power supply, delivery organisations, third parties and other outside influences or events out of our control. 

Modification of Terms
We reserve the right to change the Terms of use or policies regarding the use of this website (including, in particular, those relating to price or availability) at any time and to notify you by posting an updated version of the Terms of use on the website.

Modification of Prices
While we aim to be consistent with our prices over long periods of time, we may every now and then need to modify the price of our items and artworks, whether due to third party costs (suppliers, deliveries, etc.) or for any other reason. We reserve the right to do this at any time. 

Governing Law
These Terms shall be governed by and construed in accordance with UK law and you hereby submit to the exclusive jurisdiction of the UK courts. This will not prevent Pony Ltd. from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of these terms and conditions in any other jurisdiction throughout the world.
